Terms of Service

Welcome to ReelTour AI. These Terms of Service ("Terms") are a legal agreement between you ("Client," "you," or "your") and ReelTour AI ("ReelTour," "we," "us," or "our") governing your access to and use of our website, content production services, and related deliverables (collectively, the "Services").

By accessing the website, submitting a demo request, subscribing to a plan, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. The Services

ReelTour AI transforms real estate listings into cinematic video and marketing content, including but not limited to cinematic walkthroughs, hook clips, short-form social videos, AI-generated digital twin content, branded graphics, written captions, and related deliverables. Exact deliverables depend on the plan or package you subscribe to.

2. Eligibility

You must be at least 18 years old and a licensed real estate professional, team member, or authorized representative of a brokerage to use the Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and current.

3. Accounts and Communications

To use certain features — including the client portal — you may need to create an account or verify your email through a magic link. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately of any unauthorized use.

By providing your email address or phone number, you consent to receive communications related to your account and the Services. Marketing communications may be opted out of at any time.

4. Content You Provide

Your rights and responsibilities

You represent and warrant that you own or have all necessary rights, licenses, and permissions to share any listing URL, photograph, video, floor plan, description, logo, or other material ("Client Content") with us and to have that material used in the production of deliverables. This includes any MLS photos, brokerage branding, or third-party assets you submit.

You are solely responsible for confirming that your use of Client Content and our deliverables complies with MLS rules, brokerage requirements, fair housing laws, advertising regulations, and any other applicable law.

License to ReelTour

You grant ReelTour a non-exclusive, worldwide, royalty-free license to access, reproduce, modify, adapt, and use Client Content solely for the purpose of providing the Services, producing deliverables, and, with your consent, showcasing finished work in our portfolio and marketing materials. You may revoke portfolio use at any time by written request.

5. Deliverables and Ownership

Upon full payment of applicable fees, you receive a perpetual, worldwide, non-exclusive license to use the finished deliverables we produce for you ("Deliverables") for your personal real estate marketing purposes, including advertising the relevant listing and promoting yourself as an agent.

ReelTour retains ownership of all underlying templates, workflows, models, style systems, and production methods used to create Deliverables. Nothing in these Terms transfers ownership of our tools, software, or intellectual property to you.

You may not resell, sublicense, or repackage Deliverables as a stand-alone product or service to other agents or brokerages without our written consent.

6. Subscription Plans, Billing, and Cancellation

Plans and billing

Our Services are offered on a subscription basis, typically billed monthly in advance. Pricing for each plan is displayed on our website and may be updated from time to time. By subscribing, you authorize us (and our payment processor) to charge the payment method you provide for recurring fees until you cancel.

Cancellation

You may cancel your subscription at any time by notifying us in writing or through the client portal. Cancellations take effect at the end of the current billing cycle. You will continue to have access to Services and Deliverables already produced through the end of that cycle.

Refunds

Because Deliverables are custom-produced for you, fees for completed or in-production deliverables are non-refundable. We may, at our sole discretion, offer partial refunds or credits for services that have not yet been started.

Turnaround

We strive to deliver work within the timeframes described on our website and in your plan (typically 24–72 hours from receipt of a complete listing submission). Timeframes are good-faith estimates, not contractual guarantees, and may be affected by volume, complexity, or Client Content readiness.

7. Acceptable Use

You agree not to use the Services to:

• Submit Client Content you do not have the right to use or that infringes any third-party rights.
• Misrepresent properties, falsify listing details, or violate MLS or brokerage rules.
• Produce content that violates fair housing laws or discriminates against protected classes.
• Harass, defame, or impersonate others, including other agents or clients.
• Reverse engineer, copy, or resell our Services, templates, or underlying technology.
• Use Deliverables to market properties you are not authorized to represent.
• Interfere with the security or operation of our website, client portal, or systems.

We reserve the right to suspend or terminate your access to the Services for violations of these Terms.

8. AI-Generated Content

Certain Deliverables are created using artificial intelligence tools, including image generation, video generation, and voice cloning technology. By submitting Client Content and requesting such Deliverables, you acknowledge and consent to the use of AI in the production process.

If Deliverables include an AI-generated likeness or voice of you (an "AI digital twin"), you represent that you are the person being replicated and you grant us a license to produce and deliver that content for your real estate marketing. You may request deletion of your digital twin assets at any time.

9. Third-Party Services

The Services rely on third-party providers including, but not limited to, Supabase, Formspree, Calendly, Vercel, Stripe, Google, Apollo.io, and various AI production tools. Your use of those third-party services may be subject to their own terms. We are not responsible for the availability, actions, or content of third parties.

10. Disclaimers

THE SERVICES AND DELIVERABLES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, REELTOUR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE ANY SPECIFIC OUTCOMES, INCLUDING BUT NOT LIMITED TO THE SALE OF A LISTING, LEAD VOLUME, MEDIA ENGAGEMENT, COMMISSION EARNINGS, OR MARKET PERFORMANCE. MARKETING RESULTS DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REELTOUR, ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST COMMISSIONS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless ReelTour and its affiliates, officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:

• Your use of the Services or Deliverables.
• Your breach of these Terms.
• Client Content you submit, including any claim that Client Content infringes third-party rights or violates any law.
• Your misrepresentation of a listing or violation of MLS, brokerage, or fair housing rules.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Services ends immediately, though licenses granted for Deliverables you have paid for survive termination unless stated otherwise.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which ReelTour AI is principally located, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the appropriate state or federal courts located in our principal place of business, and you consent to personal jurisdiction and venue in those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date at the top. Your continued use of the Services after any change constitutes acceptance of the revised Terms.

16. Miscellaneous

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReelTour regarding the Services.
